Summary of our Terms and Conditions

The information set out below is a summary of our key terms for information purposes only. This does not replace the full terms and conditions (the “Daily Fantasy TOS”) set out below. You should read and agree to the full Daily Fantasy TOS before registering and using our Service. In the event of any conflict between this summary and the full Daily Fantasy TOS, the full Daily Fantasy TOS will apply.

By using our Service, you will enter into a legally binding agreement with us (Oath (EMEA) Limited) which incorporates these terms and conditions, the Yahoo Terms of Service and Official Rules (see sections 1 and 4.1).
When you use the Service, you must be 18 years or age or older, be located in Great Britain and meet the other eligibility and verification criteria to use our Services (see section 2.1).
We will need to complete our verification checks before allowing you to withdraw winnings from your account (see sections 2.5, 2.6 and 3.2).
You must have a Yahoo ID to use our Service (see section 3.1).
You are only to play a Contest under one Yahoo ID, unless Yahoo has provided express written consent permitting you to play under an additional Yahoo ID (section 3.4).
Entrants funds are kept in accounts separate from business accounts but they would form part of the assets of the business in the event of insolvency. This meets the Gambling Commission’s level of basic segregation (see section 4.7).
Any complaints will be first handled by our Customer Care Team with a right to refer a Dispute to the Independent Betting Adjudication Service (IBAS) (see section 10).
We collect and may use your personal information in accordance with our Privacy Policy (see Section 12).

1. ACKNOWLEDGMENT AND ACCEPTANCE OF THE YAHOO DAILY FANTASY TERMS OF SERVICE

Welcome to the Yahoo Sports Daily Fantasy service (“Yahoo Sports Daily Fantasy” or the "Service"), a service through which registered Yahoo users can play daily fantasy games. The Service is offered by Oath (EMEA) Limited (formerly known as Yahoo! EMEA Limited):

References throughout this document to “Yahoo” are to Oath (EMEA) Limited.

This Yahoo Daily Fantasy Terms of Service (“Daily Fantasy TOS”) sets forth terms and conditions, additional to the Yahoo Terms of Service (“TOS”), that govern your access to and use of the Service and your participation in the contests offered therein (each, a “Contest”). This Daily Fantasy TOS incorporates by reference the terms and conditions of the Yahoo Sports Rewards Points program at https://policies.yahoo.com/ie/en/yahoo/terms/sports/rewardspoints/index.htm.

This Daily Fantasy TOS and the TOS, together with any additional terms, addendums, or documents that may be referenced herein and therein are collectively, the “Agreement”. Your use, or continued use of the Service constitutes acceptance of the Agreement. Do not use the Service if you do not wish to be bound by the Agreement.

Capitalized terms not defined in this Daily Fantasy TOS have the meanings ascribed to them in the TOS. Certain defined terms in this Daily Fantasy TOS are included in the definitions of capitalized terms in the TOS. If there is a conflict between the terms of the Daily Fantasy TOS and the TOS, the terms of the Daily Fantasy TOS shall control.

2. ELIGIBILITY

2.1 An entry to a Contest is void where it would be prohibited under the terms of the Agreement. To be eligible to enter any paid prize Contest, you must meet all of the following conditions:

You are at least 18 years of age;
You are a resident of United Kingdom ("UK") (“Eligibility Area”);
You are physically located in the Eligibility Area at the time of your participation in a Contest;
You are not listed on any UK and/or US Government prohibited or watch list and you are not listed on the “Consolidated list of persons, groups and entities subject to EU financial sanctions” published by the European Union, and
You must provide valid information during the Yahoo ID registration process.

2.2 Free-to-enter prize Contests are subject to the terms located here. To the extent of any inconsistencies these terms will prevail over the Daily Fantasy TOS.

2.3 Employees and agents of Yahoo, its affiliates, subsidiaries, advertising and promotional agencies, any other prize sponsor and any entity involved in the development, production, implementation, administration or fulfillment of the Contests (all the foregoing, together with Yahoo, collectively referred to as “Contest Entities”), and the immediate family members and persons living in the same household as any of the above may not participate in any publicly available paid Contests or free contests with cash or cash equivalent prizes except for purposes of testing the user experience on a limited basis. Participation in free contests with no prizes and private Contests is permitted.

2.4 Athletes, coaches, and other team management, team support personnel, and team owners are not eligible for any Contests in the sport or sports in which their team competes. Team owners, referees, league employees, sports commissioners and other individuals who, through an ownership interest or game-related employment, can influence gameplay in the real world game are also ineligible. It is a condition of an entry to a Contest that for such entry to be valid, that you must not be in breach of any rules regarding irregular and/or suspicious betting or misuse of inside information relevant to a sports governing body, other professional body of which you are a member, or your employer. Where a breach of these rules is identified, we shall have discretion to void the entry.

2.5 Gambling under the age of 18 is a criminal offence. We take our responsibilities to prevent access by under 18s very seriously. We may carry out appropriate checks to verify your age. If we find that you are under the age of 18 we will

suspend or terminate your access to Yahoo Sports Daily Fantasy,
prevent you from making any withdrawals, and
return to you all deposits which were placed by you but no winnings will be paid, and
we may also disqualify you from current or future Contests.

Please note that until we have verified you are over the age of 18, you will not be permitted to withdraw any winnings, in accordance with clause 3.2.

2.6 We are committed to preventing Yahoo Sports Daily Fantasy from becoming a source of crime or disorder, being associated with crime or disorder or being used to support crime. We may investigate suspicious transactions and may carry out appropriate checks to verify your identity. If necessary, we may report suspicious transactions to the competent authorities. We may also perform credit reference and fraud checks in order to verify whether you are eligible to play Yahoo Sports Daily Fantasy. In the event of such suspicious transactions or where we are unable to identify your identity, we may refuse to process any withdrawals, suspend or terminate your access to Yahoo Sports Daily Fantasy and we may disqualify you from current or future Contests.

3. OPENING AND MAINTAINING YAHOO SPORTS DAILY FANTASY ACCOUNTS

3.1 A valid Yahoo ID is required to participate in Yahoo Sports Daily Fantasy. If you do not have a Yahoo ID, you will be prompted to sign up for one before being permitted to enter or participate in a Contest offered on Yahoo Sports Daily Fantasy. Please ensure that your contact information is accurate, up-to-date, and complete. This information is mandatory if you wish to be eligible to win and collect prizes. A user who has not provided valid registration information will automatically be deemed ineligible and will not be considered for a prize.

3.2 We undertake appropriate checks to verify your age and identity within 72 hours of registering for Yahoo Sports Daily Fantasy and making your first deposit. Within those 72 hours you will be able to deposit funds and participate in Contests, but you will not be able to withdraw any winnings. If we are unable to verify your age and/or identity within 72 hours we will suspend your access to Yahoo Sports Daily Fantasy until your age and/or identity checks have been successfully completed.

3.3 Please note that the Contests may only be played under the Yahoo ID with which they were created or entered, and may not be transferred to another Yahoo ID or played by another person. Also, you may not share an account with another person or allow another user to play under your Yahoo ID. If another person accesses your Yahoo ID you are solely responsible for all their actions whether or not their access was authorised by you and you will be responsible and liable to Yahoo for all costs, claims, expenses and damages arising in connection with the use of or access to your account by any third party.

3.4 Likewise, you may not enter a Contest on behalf of someone without a Yahoo ID, or that is ineligible to participate in the Contest. As a rule, each Contest entrant (“Entrant”) is allowed to play under one Yahoo ID. You are not permitted to play using an additional Yahoo ID without explicit and written consent from Yahoo. In the event you require a second ID, please contact Yahoo at here. It is at Yahoo’s sole discretion and judgment to determine whether multiple Yahoo IDs belong to the same Entrant. If you are found to be participating in the Contests using more than one Yahoo ID without explicit and written consent from Yahoo, such penalties may include, but are not limited to, terminating your access to Yahoo Sports Daily Fantasy and/or disqualification from current and future Contests.

4. YAHOO DAILY FANTASY RULES

4.1 How To Play:

In addition to these Daily Fantasy TOS, additional rules, instructions and guidelines regarding game play and scoring (which are fully incorporated into this Daily Fantasy TOS by reference) are located at https://uk.sports.yahoo.com/dailyfantasy/help/soccer/rules (the “Official Rules”). We recommend that you retain a copy of the Official Rules. In the event of a conflict between the Official Rules and the Daily Fantasy TOS, the Daily Fantasy TOS will take precedence.

4.2 Contests:

Contest winners are determined using the criteria set forth in the posted rules for each Contest, and through the relative knowledge and skill of entrants to score the highest amount of Contest points from the accumulated statistical results of the performance of individual athletes in multiple real-world sporting events. All prizes offered are established and made known to Entrants in advance of a Contest and the value of prizes are not subject to change dependent on the number of Entrants or the amount of any fees paid by those Entrants. No Contests offered on Yahoo Sports Daily Fantasy are based solely on the score, point spread, or any performance(s) of any single real-world team or any combination of such teams, or solely on any single performance of an individual athlete in any single real-world sporting or other event.

4.3 Contest Entry:

Contests on Yahoo Sports Daily Fantasy will display an entry fee listed in GBP. Once you select the Contest you wish to enter and submit the athletes in your lineup, your Yahoo Sports Fantasy account balance will be debited for the respective entry amount. Additional funds may be deposited into your Yahoo Sports Fantasy account at any time if you do not have enough funds to enter a Contest.

Certain Contests may offer an entry reservation feature. These Contests will permit you to pay your entry fee to reserve a space in the Contest without completing your lineup. Once you reserve your entry in any Contest with this feature, your Yahoo Sports Fantasy account balance will be debited for the respective entry fee amount. If you do not return to your entry and submit a lineup before lineups lock, you will be awarded zero points in the Contest and your entry fee will not be refunded.

4.4 Contest Term:

The term and length of each Contest will depend on the professional sport related to that Contest, generally commencing and ending either on a single day or over the course of a week. The length of each individual Contest will be explicitly stated on its respective Contest page.

4.5 Prizes:

At the conclusion of each Contest, Yahoo will display the list of potential Contest winners (subject to verification) generally on the following day. These Contest results will not be changed due to any subsequent official adjustments of statistics by Yahoo’s data providers unless otherwise determined by Yahoo at its sole discretion. All prizes offered are established and made known to Entrants in advance of each Contest and are listed on each respective Contest page. In the event of a tie, Yahoo will combine the winning prizes and evenly distribute the prizes to the tied Entrants. For example, if three Entrants tie for 1st place, with 1st place winning GBP 100, 2nd place winning GBP 50, and 3rd place winning GBP 30, each of the tied Entrants will receive GBP 60.

All potential winners are subject to verification by Yahoo, and must meet all eligibility requirements before a prize will be awarded. In addition, you MUST provide valid contact information during the Yahoo ID registration process to be considered for a prize. An entrant who finishes in a prize-winning position in a Contest, but has not provided valid contact information during the Yahoo ID registration process will be deemed ineligible.

If you are a potential winner, you may also be required to sign and return a Declaration of Eligibility and Liability. You will be required to provide this information within ten (10) days after Yahoo first attempts to contact you. If you fail to comply with this deadline, or if a prize or prize notification is returned as undeliverable, Yahoo may disqualify you from further participation, and withhold or revoke any prizes at its sole discretion. Winners will have their prizes deposited in their Yahoo Sports Fantasy account.

Prizes may not be transferred or assigned except by Yahoo. Only listed prizes will be awarded and no substitutions, equivalents or redemptions will be made. Any expenses, together with the reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of a prize, are the sole responsibility of the winner of that prize. A potential winner may be required to provide additional documentation in order to comply with tax reporting requirements. Yahoo makes no representations or warranties concerning the appearance, safety, or performance of any prize awarded. Any unclaimed prizes will not be awarded. Contest Entities will not replace any lost or stolen prize items.

4.6 Withdrawals:

Entrants may withdraw cash prize winnings and any cash deposits (excluding bonuses and promotions) once funds have settled into an entrant's account.

Withdrawals will be deposited directly into your payment instrument that you have used to deposit funds.

We reserve the right to require proof of identity, to assist us with age and/or identity verification, prior to processing a withdrawal.

Bonuses and promotions may be offered by Yahoo Sports Daily Fantasy from time-to-time. Any cash bonuses and promotions you receive may not be withdrawn from your Yahoo Sports Daily Fantasy account unless certain conditions are met as stated by the terms for each applicable bonus or promotion. These terms may include, but are not limited to, using the bonus to enter into at least one Contest. Any attempted abuse of bonuses is prohibited, and may result in the loss of bonuses, voidance of winnings and the suspension of an account(s) on the Service. Yahoo considers the following behaviour to constitute abuse of bonuses:

(a) a person making a cash deposit to their account, receiving a bonus in Yahoo Sports Rewards Points, then withdrawing the cash deposit and only using the Yahoo Sports Rewards Points to enter a Contest;

(b) receiving a bonus and intentionally transferring (by winning or losing a Contest) such funds to another account, including but not limited to another account set up by the same player or an account of an associate of the player;

(c) claiming a 'new registration bonus' that is only for persons who do not already have an account on the Service, despite already having an account on the Service.

4.7 Funds Protection:

We are required by our licence to inform Entrants about what happens to funds which we hold on account for Entrants in the event of insolvency. See:

Entrants funds are kept in accounts separate from business accounts but they would form part of the assets of the business in the event of insolvency. These accounts may include bank accounts, investment accounts and other accounts. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: basic segregation.

4.8 Cancellation Policy:

If any Contest is not capable of running as planned, for any reason including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Yahoo which corrupt or affect the administration, security, fairness, integrity or proper conduct of any Contest, Yahoo reserves the right at its sole discretion to cancel, terminate, modify, or suspend a Contest without any further obligation.

In the event Yahoo is prevented from continuing with a Contest or the integrity and/or feasibility of a Contest is severely undermined by any event beyond the control of Yahoo, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus, unauthorized intervention, technical failures or other cause not reasonably within the control of Yahoo (each a “Reason Beyond Our Control”), Yahoo reserves the right at its sole discretion to cancel, terminate, modify, or suspend a Contest without any further obligation.

5. CONDUCT

By accessing and using Yahoo Sports Daily Fantasy and entering a Contest, you agree to be bound by the decisions of Yahoo, which are final and binding in all respects. Yahoo reserves the right at its sole discretion to disqualify any individual it finds to be (a) tampering or attempting to tamper with the entry process or the operation of Yahoo Sports Daily Fantasy, any Contest, or any Yahoo website; (b) violating the Official Rules, these Daily Fantasy TOS, or any other guidelines, rules, or instructions associated with Yahoo Sports Daily Fantasy or the Contests; (c) violating the TOS, conditions of use and/or general rules or guidelines of any other Yahoo product or service; (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (e) committing an action deemed to be improper conduct.

Actions deemed as improper conduct include, but are not limited to, those actions outlined in the “User Content And Conduct” section of the TOS, as well as the following:

Providing false information about your eligibility to enter Contests and collect prizes
Using any fraudulent, or unauthorized credit cards, or payment methods
Using any automated services or routines including, but not limited to, robots, web crawlers, spiders, ants, and scrapers to access and/or collect information on any Yahoo site without explicit written consent from Yahoo; this includes uploading, editing or otherwise modifying lineups using any automated scripts or tools or otherwise interacting with Yahoo Sports Daily Fantasy using methods or technology other than the Yahoo-provided interface and technology
Attempting to abuse, bonuses and promotions, in a manner listed above at 4.6.
Attempting to tamper with, or alter a real-life sporting event that is directly connected with the Contests in which you have direct involvement or interest
Sharing your lineup with other individual(s) prior to a contest starting, including for purposes of engaging in syndicate play or otherwise attempting to collude with other players

If you create a Yahoo ID, nickname, or Contest name that Yahoo deems, in its sole discretion, to be abusive, defamatory, harassing, hateful, indecent, objectionable, offensive, or vulgar, we reserve the right to cancel any Contests you created, cancel any of your Contest entries, and block your Yahoo Sports Daily Fantasy account from any future activity. In such circ*mstances, Yahoo will refund pending entry fees and user may withdraw their current balance.

If you, as an Entrant, notice any improper conduct, please notify our Customer Care team at once using the following link so that we can investigate and take the appropriate action – if any is deemed necessary – against the offending entrants and accounts.

Please note that a violation of this Daily Fantasy TOS, the Official Rules, the TOS, and/or the general guidelines of any Yahoo product or service may be enforced against all other activities associated with the offending Yahoo ID. If your Yahoo ID is found to be in violation of the TOS or official rules of another Yahoo product or service, that violation is grounds for Yahoo to suspend or terminate your access to all products or services played under your Yahoo ID – including Yahoo Sports Daily Fantasy.

If we consider that you have attempted to defraud us, any other customer or any person in any way, including (but not limited to) payment fraud, or if we suspect you of fraudulent payment, including use of stolen debit/credit cards, transfer/receipt of funds to other customer accounts, forgery, collusion or the provision of false registration data or any other fraudulent activity, prohibited transaction or criminal activity (including but not limited to money laundering), we reserve the right to suspend and/or close your account, withhold any or all winnings and share information (together with your identity) with the police and other appropriate authorities, including the Gambling Commission.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR MOBILE APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF YAHOO SPORTS DAILY FANTASY OR THE CONTESTS MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, YAHOO RESERVES THE RIGHT TO IMMEDIATELY TERMINATE THE ENTRANT’S ACCOUNT, IF ANY, AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

6. YOUR RESPONSIBILITY TO YAHOO

To the fullest extent permitted by applicable law, you will be responsible and liable to Yahoo for any claim or demand, including reasonable legal fees, made by any third party due to or arising out of content you submit or otherwise make available through Yahoo Sports Daily Fantasy, your use of, or connection to, Yahoo Sports Daily Fantasy, your violation of the Daily Fantasy TOS, or your violation of any rights of another.

7. NO WARRANTY

7.1 Yahoo Sports Daily Fantasy is provided "as is" and the Yahoo cannot give you any guarantees with respect to Yahoo Sports Daily Fantasy. In particular, the Contest Entities cannot represent or guarantee that:

your use of Yahoo Sports Daily Fantasy will meet your requirements;
your use of the Yahoo Sports Daily Fantasy will be uninterrupted, timely, secure or free from error;
any information obtained by you as a result of your use of Yahoo Sports Daily Fantasy will be accurate or reliable; and
defects in the operation or functionality of any software provided to you as part of Yahoo Sports Daily Fantasy will be corrected.

7.2 No conditions or other terms including any implied terms (including any implied terms as to non-infringement of intellectual property rights apply to Yahoo Sports Daily Fantasy.

7.3 Nothing in the Daily Fantasy TOS affects your legal rights which you are always entitled to as a consumer and that you cannot contractually agree to alter or waive.

8. LIMITATION OF LIABILITY

8.1 You agree that your use of Yahoo Sports Daily Fantasy is at your sole risk. You understand that you may lose money by playing Contests and accept that you are fully responsible for any such loss. You agree that under no circ*mstances will any amounts lost by you under any bet be recoverable from us.

8.2 Yahoo has no responsibility to you or to pay you compensation for financial loss or loss of opportunity, goodwill, reputation, business, revenue, profit, or savings you expected to make, or wasted expenditure:

for any lost, late, misdirected or garbled entries, or for theft, destruction, or unauthorized access to, entries.
for any incorrect or inaccurate information, caused by website users.
for any breach of the Daily Fantasy TOS if such a breach is caused by a reason beyond our control.

8.3 We accept responsibility if you are injured or die as a direct result of our negligence. We will not limit this responsibility.

9. RESPONSIBLE GAMING

9.1 Yahoo is committed to helping its Yahoo Sports Daily Fantasy users to play responsibly. Further details are laid out in our Responsible Gaming Policy, located at

9.2 Account Limits: Yahoo helps Yahoo Sports Daily Fantasy users to limit the amount of money spent on Yahoo Sports Daily Fantasy by applying a deposit limit facility (“Account Limit”). Further details in relation to Account Limits are laid out in our Responsible Gaming Policy.

9.3 Time Out: Yahoo offers a timeout feature to help Yahoo Sports Daily Fantasy users if they feel that they need to take a break from playing Yahoo Sports Daily Fantasy in order to regulate the amount of time or money they spend in Yahoo Sports Daily Fantasy. Further details in relation to our timeout facility are laid out in our Responsible Gaming Policy.

9.4 Self Exclusion: Yahoo offers a self exclusion feature to help Yahoo Sports Daily Fantasy users if they feel that their usage of Yahoo Sports Daily Fantasy is out of control and they want to take a long term break. Further details in relation to the self exclusion feature are laid out in our Responsible Gaming Policy.

10. DISPUTE RESOLUTION

10.1 Our Customer Care team is available via the web to address any concerns you may have regarding the Service (“Complaints”). Our Customer Care team is able to resolve most Complaints quickly to our Entrants’ satisfaction.

10.2 If your Complaint relates to the (i) outcome of a gambling transaction and (ii) is not resolved to your satisfaction at the first stage of the Complaint process as detailed above, this will be classified as a “Dispute” and you can refer the Dispute to the Independent Betting Adjudication Service ("IBAS") through their website http://www.ibas-uk.com/ in order to get the Dispute resolved. IBAS provides a free-of-charge service. Where a Dispute is referred to IBAS, the resulting decision shall be final and binding. You agree that you shall not disclose the existence, nature or detail of any Complaints and Disputes to any third party. Details of the outcome of Disputes referred to IBAS will be provided by us to the Gambling Commission.

11. TERMINATION

In addition to the termination rights specifically stated elsewhere in this Agreement, we may terminate this Agreement with immediate effect by notice in writing by email to you. Upon termination of the Agreement for any reason:

the accrued rights, remedies, obligations and liabilities of each party as at expiry or termination shall not be affected, including the right to claim damages in respect of any breach of this Agreement which existed at or before the date of termination or expiry; and
sections which expressly or by implication have effect after termination shall continue in full force and effect.

12. PRIVACY

By using Yahoo Sports Daily Fantasy and by entering the Contests, you agree to Yahoo’s use of your personal information, as described in these Daily Fantasy TOS and/or the Yahoo Privacy Policy, located at

https://policies.yahoo.com/ie/en/yahoo/privacy/index.htm (and any successor pages).

13. WINNER’S LIST

While potential winners may be posted on the Contest Site at the conclusion of each Contest, all potential winners are still subject to verification and must meet all eligibility requirements before a prize will be awarded.

14. PUBLICITY

Yahoo may request that you sign and return a publicity release to confirm your grant of rights to Yahoo hereunder.

15. CONSUMER RIGHTS

You have legal rights in relation to services not carried out with reasonable care and skill. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards Office. Nothing in this Agreement will affect these legal rights.
